Terms of Service

Agreement

These terms are an agreement between Relay Systems (“we”, “us”) and the business or person using our service (“you”). By creating an account or using Relay Systems, you agree to these terms and to our Privacy Policy. If you use Relay Systems for a business, you confirm you're allowed to accept these terms for it.

The service

Relay Systems provides automation software for businesses, such as answering missed calls, texting callers back, asking qualifying questions, creating leads and notifying the business. We provide a phone number for your business on our messaging provider and send messages on your behalf according to your automation settings.

Your account

• Give accurate information and keep it up to date.
• Keep your password safe. You're responsible for activity on your account.
• Tell us right away if you think your account has been accessed without permission.

Text messaging rules

Text messaging is regulated. When Relay Systems texts people on your behalf, you agree that:

• Messages are sent only to people who contacted your business first (for example by calling or texting your business), and only about their inquiry.
• You will not use Relay Systems to send marketing, spam, or messages to people who haven't contacted you, and you won't send prohibited content (including illegal, hateful, deceptive or adult content).
• People who reply STOP are opted out automatically, and you won't try to message them again through Relay Systems.
• You will comply with applicable laws, including the Telephone Consumer Protection Act (TCPA), and carrier rules. We may need information about your business to register your messaging with carriers.

For people receiving messages: Relay Systems sends texts on behalf of the business you contacted, about your inquiry. Message frequency varies. Message and data rates may apply. Reply STOP to opt out at any time, or HELP for help. You can also contact us at support@relaysystems.link. Carriers are not liable for delayed or undelivered messages. Consent to receive messages is not a condition of any purchase.

Acceptable use

You agree not to:

• Break the law or anyone else's rights using Relay Systems.
• Try to access other businesses' data, or interfere with or overload the service.
• Reverse-engineer, resell or copy the service without our written permission.

We may suspend accounts that break these rules or put the service or other users at risk.

Plans, trials and payment

• Paid plans are billed monthly in advance through Stripe, at the price shown when you subscribe.
• New businesses can start a free trial. If no payment method is added by the end of the trial, the subscription ends automatically and you won't be charged.
• You can change or cancel your plan at any time from Billing. Cancellations take effect at the end of the current billing period; we don't provide refunds for partial months unless required by law.
• Each plan has limits, such as the number of active automations and leads per month.
• We may change prices with at least 30 days' notice. Changes apply from your next billing period.

Your data

You own the data you and your customers put into Relay Systems. You give us permission to use it only to provide and improve the service, as described in our Privacy Policy. You're responsible for having the right to collect and use your customers' information.

Third-party services

Relay Systems relies on providers such as telephone carriers, messaging and email providers and Stripe. We aren't responsible for their outages, and carriers may delay or block messages.

Availability and changes

We work to keep Relay Systems running reliably but can't promise it will always be available or error-free. We may improve, change or discontinue features; if we make a change that significantly affects you, we'll let you know in advance where we can.

Disclaimers and limitation of liability

The service is provided “as is” and “as available”. To the extent allowed by law, we disclaim implied warranties, and we aren't liable for indirect, incidental or consequential damages, or for lost profits, revenue or business opportunities (including missed calls or leads). Our total liability for any claim is limited to the amount you paid us in the 12 months before the claim.

Ending the agreement

You can stop using Relay Systems and cancel at any time. We may suspend or end your access if you break these terms or don't pay. After cancellation, we may delete your data after a reasonable period, as described in our Privacy Policy.

Governing law

These terms are governed by the laws of the State of Arizona, without regard to its conflict-of-law rules.

Changes to these terms

We may update these terms. We'll change the “last updated” date above and notify businesses of significant changes. Continuing to use Relay Systems after a change means you accept the updated terms.
